The Legist provides comprehensive IP services and it’s core IP practice includes:
- Understanding of the commercial issues arising from IP disputes or related negotiations and devising innovative and strategic solutions to deal with them. Working with the clients to build, manage and maintain their intellectual property portfolios on a worldwide basis. Advising clients on as to how to enforce, and extract value from their rights in these portfolios without embroiling into litigation.
- Assisting clients in creating, protecting, managing and exploitation of trademark, copyright rights, patents and domain names to their protection against infringement, misappropriation, deceptive trade practices, and counterfeiting. Devising strategies and initiating anti piracy and anti counterfeiting actions with a global approach to combat the problem, both in the source countries and in the distribution /user countries like India. The Legist have been doing anti counterfeiting actions both civil and criminal for the vulnerable FMCG, software and luxury goods industries.
- Providing assistance to clients with matters related to the acquisition, conception, creation, development, implementation, integration, use, licensing, financing, marketing, and sale of technology and intellectual property. Our intellectual property attorneys works very closely with corporate attorneys on intellectual property matters that arise as part of comp complex mergers & acquisitions, financings, outsourcing transactions and technology licensing.
- Representing client in all phases of intellectual property disputes and IP litigations.
- We formulate comprehensive intellectual property strategies involving identifying the IP of clients and their competitors, and devising offensive and defensive strategies to protect our client's core and ancillary IP.
- It includes Drafting, filing and prosecuting applications in respect of copyrights, industrial designs and trademarks. We also co-ordinate with international law firms in the procedural aspects of the IP registration process.
- Advising, structuring, drafting, reviewing and negotiating a diverse range of intellectual property agreements including license agreements, assignment agreements, reseller agreements, service provider agreements etc.
- Conducting due diligence with a specific focus on IP, involving a detailed review and documentation of IP in a company and assistance in evaluating the risks, liabilities and opportunities involved with IP.
- Advising on complex IP issues arising from emerging technologies.
- Advising on and enforcing on behalf of clients, intellectual property rights, such as patents, trademarks (including passing off and domain name disputes), copyrights, designs, trade secrets, confidentiality and non-compete provisions.
- Advising and conducting litigation to protect and defend client's intellectual property rights.
